  • Communicating with hotel guests about available accessible features
  • Guidance for hospitals during the COVID-19 pandemic regarding visitor restrictions and the assistance allowed for individuals with disabilities

While five pieces addressed pandemic-related issues, two historical documents were originally issued in 1999. The Department of Justice, which announced these withdrawals, stated that the action was intended to reduce regulatory burdens on businesses.

Reactions from Disability Rights Advocates

Critics of the withdrawal, including disability rights advocates, express concern that this indicates a decreased commitment from the federal government to enforce the ADA standards. They worry that businesses may interpret this change as a license to lower accessibility standards.

Marc Dubin, an ADA consultant and lawyer, noted that although the guidance was not legally enforceable, it served a vital role in averting lawsuits by encouraging compliance. Dubin highlighted that withdrawing this informational support could lead to an increase in legal challenges, ultimately restricting access for individuals with disabilities.

Potential Financial Impact on Businesses

Making physical accommodations for disabled customers can be costly, especially for older businesses not initially designed with ADA considerations. However, many suggestions provided in the guidance, such as ensuring clear access to parking and store entrances, were low-cost measures.

The executive director of the National Council on Independent Living, Theo Braddy, remarked that inclusive business practices can foster customer loyalty and enhance revenue. “Fully accessible businesses will attract a broader customer base, resulting in increased spending,” he stated.

Will the Lack of Guidance Lead to Challenges?

Disability advocates argue that the withdrawal of this guidance aligns with a broader trend of reducing equity initiatives within government policies. This absence of direction could encourage businesses to disregard essential ADA compliance, further marginalizing disabled individuals.

Braddy emphasized that the withdrawal sends a clear message to business owners regarding their obligations. “It creates the impression that compliance is less necessary,” he added, warning of potential setbacks in accessibility advancements.

Future of ADA Enforcement

The Department of Justice remains a primary body responsible for enforcing ADA regulations, including investigations and legal action against non-compliant businesses. However, advocates express concerns about the current administration’s commitment to robust enforcement.

Chai Feldblum, a former vice chair of the Biden administration’s AbilityOne Commission, noted that the absence of a proactive Justice Department could have serious implications for the rights of people with disabilities. “A strong and vigilant Department of Justice is crucial for safeguarding these rights,” Feldblum explained.
